Children's Online Privacy Protection Act

The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13 years of age. We do not knowingly collect or solicit personally identifiable information from children under 16 years of age; if you are a child under 16 years of age, please do not attempt to register for or otherwise use the Services or send us any personal information. All content included as part of the Site, such as text, graphics, logos, and images, as well as the compilation thereof, and any software used on the Site, is the property of Seismiq or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

International Users

The Site is controlled, operated, and administered by Seismiq from within the United States. If you access the Site from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use the Seismiq content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Indemnification and Procedures

You agree to indemnify, defend and hold harmless Seismiq, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site, your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Seismiq reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Seismiq in asserting any available defenses.

Limitations of Liability and Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SEISMIQ, ITS AFFILIATES, OR THEIR RESPECTIVE REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES.

SEISMIQ PROVIDES THE SITE ON AN "AS IS" AND "AS AVAILABLE" BASIS. SEISMIQ DOES NOT REPRESENT OR WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Termination and Access Restriction

Seismiq reserves the right, in its sole discretion, to terminate your access to the Site or any portion thereof at any time, without notice.

Governing Law

To the maximum extent permitted by applicable law, these Terms and your use of the Site are governed by the laws of the United States, without regard to conflict of law provisions. You agree that any legal action or proceeding relating to your use of the Site shall be instituted in a state or federal court in the United States. Seismiq reserves the right to amend this section upon incorporation to specify a particular state for governing law and jurisdiction.

If you are accessing the Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Seismiq with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Seismiq with respect to the Site.
